Version 1.0. In effect from 29 August 2026.
This is a summary, not the agreement. The numbered sections are what actually binds us, and if the two ever disagree, the sections win.
MakerBay is a product of Appa Technologies Pty Ltd (ABN 71 654 768 984), of 4 Greenwood Place, Freshwater NSW 2096, Australia. In these terms, “we”, “us” and “MakerBay” mean that company.
“You” means the business that holds the account. If you are signing up for a company or a partnership, you are telling us you are allowed to agree to this on its behalf, and these terms bind it.
“Your customer” means the people you do the work for. They are not party to this agreement and they have no account with us.
MakerBay is software for running a small trade or service business: a booking page, a contact list, quotes, invoices, review requests, an assistant that answers enquiries, and the messages that go with all of it. You use it over the internet. There is nothing to install.
We add to it and change it. Features get better, and occasionally one that nobody uses is removed. If we remove something you rely on, we will tell you in the product before it goes.
You need to be at least 18 and running, or setting up, a real business. Keep your sign-in details to yourself. Anything done from your account is treated as done by you, so if you think someone else has got into it, email support@makerbay.app and we will help you shut it down.
If you invite staff, you stay responsible for what they do in your workspace, and for removing them when they leave.
We will never ask you for your password or a sign-in code. If a message claiming to be from us does, it is not from us.
This is the part that matters most, so it is in plain terms.
When MakerBay emails or texts your customer, it goes out with your business name on it. You are the one with the relationship. So you are responsible for having a real reason to contact them, and you promise us that every address and number you put into MakerBay came from someone who dealt with you.
You must not use MakerBay to send:
MakerBay only sends transactional messages, meaning a message caused by something specific: a booking made, a quote sent, an invoice due, a job finished. That is a deliberate limit on the product, and it is also the basis on which our email provider lets us send at all. If your sending causes complaints or bounces at a rate that puts that at risk, we may pause your sending and tell you why. We would rather do that than lose the ability to deliver everybody’s invoices.
Every message we send for you carries a way for your customer to tell us to stop, and we honour it immediately, without asking them to confirm.
Do not use MakerBay to do anything illegal, and do not:
If you find a security problem, tell us at support@makerbay.app before you tell anyone else, and we will work with you on it.
MakerBay is a monthly subscription. The price of each module is on the pricing page, and the price shown when you turn something on is the price you pay for it.
Nothing here limits your rights under the Australian Consumer Law, or the equivalent where you live. Those rights cannot be signed away and we are not trying to.
If you connect Stripe, your customer can pay a deposit or an invoice through a MakerBay page. Read this bit carefully, because people routinely assume otherwise.
Your content stays yours. Your customer list, quotes, invoices, prices, photos and booking history are all yours. We claim no ownership of them, and we do not sell them, rent them, or use them to advertise to anybody.
You give us permission to store, process and display that content to you and to your customers, because that is what running the software requires. The permission ends when you delete the content or close your account.
MakerBay stays ours. The software, the design and the name belong to us. Using MakerBay does not transfer any of that to you.
If you send us an idea or a bug report we may act on it without owing you anything, so please do not send us anything confidential in a support ticket.
We work hard to keep MakerBay up, and we build on infrastructure designed not to lose data. We are also a small company and will not pretend otherwise: we do not currently offer a guaranteed uptime figure, and MakerBay is provided as it is. If we start offering a service level commitment we will say so here, rather than quietly.
Occasionally we may need to take the service down briefly for maintenance, change how a feature works, or limit something being abused. Where we can give notice, we will.
Keep your own copy of anything you would be sorry to lose. You can export your data at any time.
Some rights cannot be excluded. Nothing in this section limits our liability for fraud, for death or personal injury caused by our negligence, or under the Australian Consumer Law or any other consumer protection law that applies to you.
Beyond that:
If you break section 4 or section 5 and it costs us money, for example a claim from someone you emailed, you agree to cover that cost.
You can close your account whenever you want. When you do, tell us if you want your data deleted and we will delete it, normally within 30 days. If you do not ask, we keep it for 90 days so you can change your mind, then delete it.
We can suspend or close your account if you seriously break these terms, if your sending puts other customers’ email at risk, or if the law requires it. Except where that would be unlawful or would defeat the point, we will tell you why, give you a chance to fix it, and always let you export your data first.
If we ever shut MakerBay down, we will give you at least 90 days to get your data out.
We will post a new version here with a new date. For a change that actually affects you, we will email you at least 30 days beforehand. Carrying on using MakerBay after that means you accept it. If you do not, cancel before it takes effect.
